Στις 15 Οκτωβρίου 2023, περισσότεροι από 800 ακαδημαϊκοί και επαγγελματίες του διεθνούς δικαίου, των μελετών συγκρούσεων και των μελετών γενοκτονίας υπέγραψαν δημόσια δήλωση με την οποία προειδοποιούν για την πιθανότητα γενοκτονίας που διαπράττουν οι ισραηλινές δυνάμεις εναντίον των Παλαιστινίων στη Λωρίδα της Γάζας. Στους υπογράφοντες περιλαμβάνονται εξέχοντες μελετητές του Ολοκαυτώματος και των σπουδών γενοκτονίας, καθώς και πολλοί μελετητές του διεθνούς δικαίου και των TWAIL (Third World approaches to international law – Προσεγγίσεις του Τρίτου Κόσμου στο διεθνές δίκαιο). Δημόσια δήλωση: Ακαδημαϊκοί προειδοποιούν για πιθανή γενοκτονία στη Γάζα

Ως ακαδημαϊκοί και επαγγελματίες του διεθνούς δικαίου, των μελετών συγκρούσεων και των μελετών γενοκτονίας, είμαστε υποχρεωμένοι να κρούσουμε τον κώδωνα του κινδύνου για την πιθανότητα διάπραξης του εγκλήματος της γενοκτονίας από τις ισραηλινές δυνάμεις κατά των Παλαιστινίων στη Λωρίδα της Γάζας. Δεν το κάνουμε ελαφρά τη καρδία, αναγνωρίζοντας το βάρος αυτού του εγκλήματος, αλλά η σοβαρότητα της τρέχουσας κατάστασης το απαιτεί.
Οι προϋπάρχουσες συνθήκες στη Λωρίδα της Γάζας είχαν ήδη προκαλέσει συζητήσεις για γενοκτονία πριν από την τρέχουσα κλιμάκωση – όπως από τη National Lawyers Guild το 2014, το Russell Tribunal on Palestine το 2014 και το Center for Constitutional Rights το 2016. Ακαδημαϊκοί έχουν προειδοποιήσει όλα αυτά τα χρόνια ότι η πολιορκία της Γάζας μπορεί να ισοδυναμεί με «προοίμιο γενοκτονίας» ή με «γενοκτονία σε αργή κίνηση». Η επικράτηση της ρατσιστικής και απάνθρωπης γλώσσας και της ρητορικής μίσους στα μέσα κοινωνικής δικτύωσης επισημάνθηκε επίσης σε προειδοποίηση που εξέδωσε τον Ιούλιο του 2014 ο Ειδικός Σύμβουλος του ΟΗΕ για την πρόληψη της γενοκτονίας και ο Ειδικός Σύμβουλος για την ευθύνη προστασίας, με αφορμή τη συμπεριφορά του Ισραήλ κατά του προστατευόμενου παλαιστινιακού πληθυσμού. Οι Ειδικοί Σύμβουλοι σημείωσαν ότι μεμονωμένοι Ισραηλινοί είχαν διαδώσει μηνύματα που θα μπορούσαν να είναι απάνθρωπα για τους Παλαιστίνιους και τα οποία καλούσαν στη δολοφονία μελών αυτής της ομάδας, και επανέλαβαν ότι η υποκίνηση για τη διάπραξη εγκλημάτων θηριωδίας απαγορεύεται από το διεθνές δίκαιο.
Ωστόσο, η τρέχουσα στρατιωτική επίθεση του Ισραήλ στη Λωρίδα της Γάζας από τις 7 Οκτωβρίου 2023 είναι πρωτοφανής σε κλίμακα και σοβαρότητα και, κατά συνέπεια, σε επιπτώσεις για τον πληθυσμό της Γάζας. Μετά την εισβολή παλαιστινιακών ένοπλων ομάδων στις 7 Οκτωβρίου 2023, συμπεριλαμβανομένων εγκληματικών επιθέσεων κατά ισραηλινών πολιτών, η Λωρίδα της Γάζας έχει υποστεί αδιάκοπους και αδιάκριτους βομβαρδισμούς από τις ισραηλινές δυνάμεις. Μεταξύ της 7ης Οκτωβρίου και της 9:00 π.μ. της 15ης Οκτωβρίου, έχουν σκοτωθεί 2.329 Παλαιστίνιοι και έχουν τραυματιστεί 9.042 Παλαιστίνιοι σε ισραηλινές επιθέσεις στη Γάζα, μεταξύ των οποίων πάνω από 724 παιδιά, τεράστιες εκτάσεις γειτονιών και ολόκληρες οικογένειες σε όλη τη Γάζα έχουν εξαφανιστεί. Ο υπουργός Άμυνας του Ισραήλ διέταξε «πλήρη πολιορκία» της Λωρίδας της Γάζας απαγορεύοντας την προμήθεια καυσίμων, ηλεκτρικού ρεύματος, νερού και άλλων βασικών αγαθών. Αυτή η ίδια η ορολογία υποδηλώνει την εντατικοποίηση μιας ήδη παράνομης, δυνητικά γενοκτονικής πολιορκίας σε μια εντελώς καταστροφική επίθεση.
Αργά στις 12 Οκτωβρίου, οι ισραηλινές αρχές έδωσαν εντολή σε περισσότερους από 1,1 εκατομμύριο Παλαιστίνιους στην πόλη της Γάζας και στη βόρεια Λωρίδα της Γάζας να εγκαταλείψουν τα σπίτια τους και να φύγουν προς τα νότια της Γάζας εντός 24 ωρών, γνωρίζοντας ότι αυτό θα ήταν πρακτικά αδύνατο για πολλούς. Οι Παλαιστίνιοι που άρχισαν να εκκενώνουν τη νότια Γάζα ανέφεραν ότι πολίτες και ασθενοφόρα έγιναν στόχοι και χτυπήθηκαν από ισραηλινές αεροπορικές επιδρομές στην καθορισμένη «ασφαλή διαδρομή», σκοτώνοντας τουλάχιστον 70 Παλαιστίνιους που έφευγαν για να αναζητήσουν καταφύγιο. Η Διεθνής Επιτροπή Ερυθρού Σταυρού δήλωσε ότι «οι εντολές εκκένωσης, σε συνδυασμό με την πλήρη πολιορκία» είναι ασυμβίβαστες με το διεθνές ανθρωπιστικό δίκαιο. Σχεδόν μισό εκατομμύριο Παλαιστίνιοι έχουν ήδη εκτοπιστεί και οι ισραηλινές δυνάμεις έχουν βομβαρδίσει πολλές φορές τη μόνη πιθανή οδό εξόδου που δεν ελέγχει το Ισραήλ, το πέρασμα της Ράφα προς την Αίγυπτο. Ο Παγκόσμιος Οργανισμός Υγείας δημοσίευσε προειδοποίηση ότι «[ο] εξαναγκασμός περισσότερων από 2000 ασθενών να μεταφερθούν στη νότια Γάζα, όπου οι υγειονομικές εγκαταστάσεις λειτουργούν ήδη στο μέγιστο της δυναμικότητάς τους και αδυνατούν να απορροφήσουν μια δραματική αύξηση του αριθμού των ασθενών, θα μπορούσε να ισοδυναμεί με θανατική καταδίκη».
Υπήρξε επίσης κλιμάκωση της βίας, συλλήψεις, εκδιώξεις και καταστροφή ολόκληρων παλαιστινιακών κοινοτήτων στην κατεχόμενη Δυτική Όχθη και την Ιερουσαλήμ. Από τις 7 Οκτωβρίου, ισραηλινοί έποικοι, με την υποστήριξη του στρατού και της αστυνομίας, έχουν επιτεθεί και πυροβολήσει Παλαιστίνιους πολίτες εξ επαφής (όπως καταγράφηκε στα χωριά a-Tuwani και Qusra), έχουν εισβάλει στα σπίτια τους και έχουν επιτεθεί σε κατοίκους. Ορισμένες παλαιστινιακές κοινότητες έχουν ήδη αναγκαστεί να εγκαταλείψουν τα σπίτια τους, μετά την άφιξη των εποίκων και την καταστροφή των περιουσιών τους. Μεταξύ 7 και 15 Οκτωβρίου, η Al-Haq κατέγραψε τη δολοφονία από τον ισραηλινό στρατό και τους εποίκους 55 Παλαιστινίων στη Δυτική Όχθη και τον τραυματισμό 1.200 Παλαιστινίων εκεί.
Οι δηλώσεις ισραηλινών αξιωματούχων από τις 7 Οκτωβρίου 2023 και μετά δείχνουν ότι πέρα από τις δολοφονίες και τον περιορισμό των βασικών συνθηκών ζωής που διαπράττονται κατά των Παλαιστινίων στη Γάζα, υπάρχουν επίσης ενδείξεις ότι οι συνεχιζόμενες και επικείμενες ισραηλινές επιθέσεις στη Λωρίδα της Γάζας διεξάγονται με δυνητικά γενοκτονική πρόθεση. Η γλώσσα που χρησιμοποιείται από ισραηλινές πολιτικές και στρατιωτικές προσωπικότητες φαίνεται να αναπαράγει ρητορική και τροπάρια που συνδέονται με γενοκτονία και υποκίνηση σε γενοκτονία. Έχουν επικρατήσει απάνθρωπες περιγραφές των Παλαιστινίων. Ο Ισραηλινός υπουργός Άμυνας Yoav Gallant δήλωσε στις 9 Οκτωβρίου ότι «πολεμάμε ανθρώπινα ζώα και ενεργούμε αναλόγως». Στη συνέχεια ανακοίνωσε ότι το Ισραήλ προχωρά σε «απάντηση πλήρους κλίμακας» και ότι «αφαίρεσε κάθε περιορισμό» για τις ισραηλινές δυνάμεις, και δήλωσε: «Η Γάζα δεν θα επιστρέψει σε αυτό που ήταν πριν. Θα εξαλείψουμε τα πάντα». Στις 10 Οκτωβρίου, ο επικεφαλής του Συντονιστή Κυβερνητικών Δραστηριοτήτων στα Εδάφη (COGAT) του ισραηλινού στρατού, υποστράτηγος Γκασάν Αλιάν, απηύθυνε μήνυμα απευθείας στους κατοίκους της Γάζας: «Τα ανθρώπινα ζώα πρέπει να αντιμετωπίζονται ως τέτοια. Δεν θα υπάρχει ηλεκτρικό ρεύμα και νερό, θα υπάρχει μόνο καταστροφή. Θέλατε την κόλαση, θα πάρετε την κόλαση». Την ίδια ημέρα, ο εκπρόσωπος του ισραηλινού στρατού Ντανιέλ Χαγκάρι αναγνώρισε τον αλόγιστο και σκόπιμα καταστροφικό χαρακτήρα της εκστρατείας βομβαρδισμών του Ισραήλ στη Γάζα: «Η έμφαση δίνεται στις ζημιές και όχι στην ακρίβεια».
Από το 2007, το Ισραήλ έχει ορίσει τη Λωρίδα της Γάζας στο σύνολό της ως «εχθρική οντότητα». Στις 7 Οκτωβρίου, ο πρωθυπουργός Μπενιαμίν Νετανιάχου δήλωσε ότι οι κάτοικοι της Γάζας θα πληρώσουν «τεράστιο τίμημα» για τις ενέργειες των μαχητών της Χαμάς. Διαβεβαίωσε ότι το Ισραήλ θα πραγματοποιήσει παρατεταμένη επίθεση και θα μετατρέψει τμήματα των πυκνοκατοικημένων αστικών κέντρων της Γάζας «σε ερείπια». Ο πρόεδρος του Ισραήλ υπογράμμισε ότι οι ισραηλινές αρχές θεωρούν το σύνολο του παλαιστινιακού πληθυσμού της Γάζας υπεύθυνο για τις ενέργειες των μαχητικών ομάδων και υπόκεινται αναλόγως σε συλλογική τιμωρία και απεριόριστη χρήση βίας: «Είναι ένα ολόκληρο έθνος εκεί έξω που είναι υπεύθυνο. Δεν είναι αληθινή αυτή η ρητορική ότι οι πολίτες δεν έχουν επίγνωση, δεν εμπλέκονται. Είναι απολύτως αναληθής». Ο Ισραηλινός υπουργός Ενέργειας και Υποδομών Ισραέλ Κατζ πρόσθεσε: «Όλος ο άμαχος πληθυσμός στη Γάζα διατάσσεται να φύγει αμέσως. Θα νικήσουμε. Δεν θα λάβουν ούτε μια σταγόνα νερό, ούτε μια μπαταρία μέχρι να φύγουν από τον κόσμο».
Στοιχεία υποκίνησης σε γενοκτονία υπάρχουν επίσης στον ισραηλινό δημόσιο λόγο. Αυτό κυμαίνεται από δηλώσεις εκλεγμένων αξιωματούχων – όπως η έκκληση του μέλους της Κνεσέτ Αριέλ Κάλνερ στις 7 Οκτωβρίου για «έναν στόχο: Nakba! [καταστροφή για τους Παλαιστίνιους] Μια Νάκμπα που θα επισκιάσει τη Νάκμπα του 1948» – μέχρι δημόσια πανό που αναρτήθηκαν σε ισραηλινές πόλεις και καλούσαν σε μια «νίκη» που σηματοδοτείται από «μηδενικό πληθυσμό στη Γάζα» και την «εξόντωση της Γάζας». Στην εθνική τηλεόραση, ο ανταποκριτής ασφαλείας Αλόν Μπεν Νταβίντ μετέδωσε το σχέδιο του ισραηλινού στρατού να καταστρέψει την πόλη της Γάζας, την Jabaliyya, την Beit Lahiya και την Beit Hanun. Τέτοιες δηλώσεις δεν είναι καινούργιες και συντονίζονται με έναν ευρύτερο ισραηλινό λόγο που αναδεικνύει την πρόθεση για εξόντωση και γενοκτονία εναντίον του παλαιστινιακού λαού. Νωρίτερα μέσα στο έτος, για παράδειγμα, ο Ισραηλινός υπουργός Οικονομικών Μπεζαλέλ Σμότριχ αποκάλεσε τους Παλαιστίνιους «αποκρουστικούς», «αηδιαστικούς» και ζήτησε να «εξαλειφθεί» ολόκληρο το παλαιστινιακό χωριό Huwwara στη Δυτική Όχθη.
Στις 12 Οκτωβρίου 2023, μια ομάδα ειδικών εισηγητών του ΟΗΕ καταδίκασε «τις αδιάκριτες στρατιωτικές επιθέσεις του Ισραήλ εναντίον του ήδη εξαντλημένου παλαιστινιακού λαού της Γάζας, που αποτελείται από πάνω από 2,3 εκατομμύρια ανθρώπους, εκ των οποίων σχεδόν οι μισοί είναι παιδιά. Ζουν υπό παράνομο αποκλεισμό εδώ και 16 χρόνια και έχουν ήδη περάσει από πέντε μεγάλους βίαιους πολέμους, οι οποίοι παραμένουν ανεξέλεγκτοι». Οι εμπειρογνώμονες του ΟΗΕ προειδοποίησαν για «την παρακράτηση βασικών προμηθειών, όπως τρόφιμα, νερό, ηλεκτρικό ρεύμα και φάρμακα. Τέτοιες ενέργειες θα επιτείνουν μια σοβαρή ανθρωπιστική κρίση στη Γάζα, όπου ο πληθυσμός της βρίσκεται πλέον σε αναπόφευκτο κίνδυνο λιμοκτονίας. Η εσκεμμένη πείνα αποτελεί έγκλημα κατά της ανθρωπότητας». Στις 14 Οκτωβρίου 2023, ο Ειδικός Εισηγητής του ΟΗΕ για την κατάσταση των ανθρωπίνων δικαιωμάτων στα κατεχόμενα παλαιστινιακά εδάφη προειδοποίησε για «μια επανάληψη της Νάκμπα του 1948 και της Νάκσα του 1967, αλλά σε μεγαλύτερη κλίμακα», καθώς το Ισραήλ πραγματοποιεί «μαζική εθνοκάθαρση των Παλαιστινίων κάτω από την ομίχλη του πολέμου».
Ο παλαιστινιακός λαός αποτελεί εθνική ομάδα για τους σκοπούς της Σύμβασης για την Πρόληψη και την Τιμωρία του Εγκλήματος της Γενοκτονίας (Σύμβαση για τη Γενοκτονία). Οι Παλαιστίνιοι της Λωρίδας της Γάζας αποτελούν σημαντικό ποσοστό του παλαιστινιακού έθνους και στοχοποιούνται από το Ισραήλ επειδή είναι Παλαιστίνιοι. Ο Παλαιστινιακός πληθυσμός της Γάζας φαίνεται να υφίσταται επί του παρόντος από τις ισραηλινές δυνάμεις και αρχές εκτεταμένες δολοφονίες, σωματικές και ψυχικές βλάβες και μη βιώσιμες συνθήκες ζωής – με φόντο ισραηλινές δηλώσεις που αποδεικνύουν ενδείξεις πρόθεσης φυσικής καταστροφής του πληθυσμού.
Το άρθρο ΙΙ της Σύμβασης για τη Γενοκτονία προβλέπει ότι «ως γενοκτονία νοείται οποιαδήποτε από τις ακόλουθες πράξεις που διαπράττονται με σκοπό την ολική ή μερική καταστροφή μιας εθνικής, εθνοτικής, φυλετικής ή θρησκευτικής ομάδας:
(α) Δολοφονία των μελών της ομάδας,
(β) Πρόκληση σοβαρής σωματικής ή ψυχικής βλάβης σε μέλη της ομάδας,
(γ) Η σκόπιμη επιβολή στην ομάδα συνθηκών ζωής που υπολογίζονται ώστε να επιφέρουν τη φυσική καταστροφή της εν όλω ή εν μέρει,
(δ) Επιβολή μέτρων που αποσκοπούν στην αποτροπή γεννήσεων εντός της ομάδας,
(ε) Βίαιη μεταφορά παιδιών της ομάδας σε άλλη ομάδα».
Όλα τα κράτη δεσμεύονται εκ του νόμου από την αρχή ότι η γενοκτονία είναι ένα έγκλημα που απαγορεύεται από το διεθνές δίκαιο. Το Διεθνές Δικαστήριο έχει επιβεβαιώσει ότι η απαγόρευση της γενοκτονίας αποτελεί επιτακτικό κανόνα του διεθνούς δικαίου από τον οποίο δεν επιτρέπεται καμία παρέκκλιση. Η Σύμβαση προβλέπει ότι τα άτομα που επιχειρούν γενοκτονία ή που υποκινούν σε γενοκτονία «θα τιμωρούνται, είτε πρόκειται για συνταγματικά υπεύθυνους άρχοντες, είτε για δημόσιους λειτουργούς, είτε για ιδιώτες».
Το άρθρο Ι της Σύμβασης για την πρόληψη και την τιμωρία του εγκλήματος της γενοκτονίας προβλέπει ότι: «Τα συμβαλλόμενα μέρη επιβεβαιώνουν ότι η γενοκτονία, είτε διαπράττεται σε καιρό ειρήνης είτε σε καιρό πολέμου, αποτελεί έγκλημα του διεθνούς δικαίου, το οποίο αναλαμβάνουν να προλαμβάνουν και να τιμωρούν». Το Διεθνές Δικαστήριο διευκρίνισε ότι «η υποχρέωση ενός κράτους να προλαμβάνει και η αντίστοιχη υποχρέωση να ενεργεί γεννάται τη στιγμή που το κράτος μαθαίνει ή θα έπρεπε κανονικά να έχει μάθει για την ύπαρξη σοβαρού κινδύνου διάπραξης γενοκτονίας. Από εκείνη τη στιγμή και μετά, εάν το κράτος έχει στη διάθεσή του μέσα που ενδέχεται να έχουν αποτρεπτικό αποτέλεσμα για όσους είναι ύποπτοι για την προετοιμασία γενοκτονίας ή είναι εύλογα ύποπτοι ότι υποκρύπτουν ειδική πρόθεση (dolus specialis), είναι υποχρεωμένο να κάνει χρήση αυτών των μέσων όπως επιτρέπουν οι περιστάσεις».
Παλαιστινιακές οργανώσεις ανθρωπίνων δικαιωμάτων, εβραϊκές ομάδες της κοινωνίας των πολιτών, μελετητές του Ολοκαυτώματος και της γενοκτονίας και άλλοι έχουν προειδοποιήσει για επικείμενη γενοκτονία κατά του παλαιστινιακού πληθυσμού στη Γάζα. Τονίζουμε την ύπαρξη σοβαρού κινδύνου διάπραξης γενοκτονίας στη Λωρίδα της Γάζας.
Οι υπογράφοντες απευθύνουν επειγόντως έκκληση στα κράτη να λάβουν συγκεκριμένα και ουσιαστικά μέτρα για την ατομική και συλλογική πρόληψη των γενοκτονικών πράξεων, σύμφωνα με τη νομική τους υποχρέωση να προλαμβάνουν το έγκλημα της γενοκτονίας. Πρέπει να προστατεύσουν τον παλαιστινιακό πληθυσμό και να διασφαλίσουν ότι το Ισραήλ απέχει από κάθε περαιτέρω υποκίνηση γενοκτονίας και από τη διάπραξη συμπεριφορών που απαγορεύονται από το άρθρο ΙΙ της Σύμβασης για τη Γενοκτονία.
Όλα τα κράτη θα πρέπει να ενεργήσουν αμέσως σύμφωνα με το άρθρο VIII και να καλέσουν τα αρμόδια όργανα των Ηνωμένων Εθνών, ιδίως τη Γενική Συνέλευση του ΟΗΕ, να λάβουν επειγόντως μέτρα σύμφωνα με τον Καταστατικό Χάρτη των Ηνωμένων Εθνών, κατάλληλα για την πρόληψη και την καταστολή των πράξεων γενοκτονίας. Σημειώνουμε ειδικά τον ρόλο της Γενικής Συνέλευσης εδώ, δεδομένου ότι το Συμβούλιο Ασφαλείας έχει εκτεθεί από τις Ηνωμένες Πολιτείες και το Ηνωμένο Βασίλειο (και τα δύο μόνιμα μέλη που έχουν δικαίωμα βέτο) που στέλνουν στρατιωτικές δυνάμεις στην ανατολική Μεσόγειο για την υποστήριξη του Ισραήλ.
Υπενθυμίζουμε ότι το 1982, η Γενική Συνέλευση καταδίκασε τη σφαγή των Παλαιστινίων αμάχων στους προσφυγικούς καταυλισμούς Σάμπρα και Σατίλα ως «πράξη γενοκτονίας». Σημειώνουμε επίσης ότι το κράτος της Παλαιστίνης δικαιούται να κινήσει, σύμφωνα με το άρθρο ΙΧ της Σύμβασης για τη Γενοκτονία, διαδικασία ενώπιον του Διεθνούς Δικαστηρίου προκειμένου να αποτρέψει τη διάπραξη γενοκτονικών πράξεων.
Τέλος, καλούμε όλους τους αρμόδιους φορείς του ΟΗΕ, συμπεριλαμβανομένου του Γραφείου για την Πρόληψη της Γενοκτονίας και την Ευθύνη για Προστασία, καθώς και το Γραφείο του Εισαγγελέα του Διεθνούς Ποινικού Δικαστηρίου να παρέμβουν άμεσα, να διεξάγουν τις απαραίτητες έρευνες και να επικαλεστούν τις απαραίτητες διαδικασίες προειδοποίησης για την προστασία του παλαιστινιακού πληθυσμού από τη γενοκτονία.
